Legal Experience

AV-rated through Martindale-Hubbell and litigates in the areas of business and commercial law, common interest developments, intellectual property, premises and retailer defense, products liability, and toxic and environmental torts.

Commercial litigation experience encompassing complex matters involving antitrust, breach of contract, contractual interference, copyright infringement, director and officer liability, domain name disputes, trade secret, unfair competition, unfair trade practices, and the Uniform Commercial Code. 

Extensive experience litigating all aspects of toxic tort and product liability cases includes a particular emphasis on expert scientific and medical issues in toxic tort cases.  Mr. Hartley also advises clients and litigates claims arising under California's "Proposition 65" (Safe Drinking Water and Toxic Enforcement Act of 1986).

Substantial trial experience and has been appellate counsel of record in several published and unpublished state and federal opinions involving products liability and toxic tort matters. 

Co-author of Federal Standards for the Admissibility of Expert Testimony Based on Novel and Unfounded Scientific Theories, Federation of Insurance and Corporate Counsel Quarterly (1992).

Admitted to practice in all state and federal courts in California, including the United States District Courts for the Northern, Central and Southern Districts, and the Ninth Circuit Court of Appeals. 

Member of the USLAW Network, Inc., and is chair of the Network’s Enviornmental, Toxic and Mass Tort practice group, and a member of USLAW Network’s business and commercial and product liability practice groups.  He is also a member of the International Association of Defense Counsel.

Mr. Hartley and his wife, Cecilia, live in Clayton, California.  They have two children (ages 24 and 18).  They devote substantial time to their community and church.  Mr. Hartley also serves on the City of Clayton’s Planning Commission and is the president of the Clayton Bocce Federation and is past president of the Clayton Business & Community Association, Inc.
